These Terms & Conditions (“Terms”) govern your access to and use of jiujitsuflo.com and our online courses and related services (collectively, the “Services”) provided by Jiu Jitsu FLO. By accessing or using the Services, you agree to these Terms and to our Privacy Policy.
1) Eligibility & accounts
You must be at least 13 years old to use the Services. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
2) Health disclaimer; assumption of risk
The Services include fitness, mobility, and breath‑work content. We are not medical professionals and the Services are not medical advice. Consult a physician before starting any exercise program. By using the Services, you voluntarily assume all risks of injury, illness, or death resulting from participation and agree that you are solely responsible for your decisions, actions, and results.
3) Release; waiver; indemnification
To the fullest extent permitted by law, you release and discharge JIU JITSU FLO LLC, its owners, officers, employees, contractors, and agents from any and all claims, demands, causes of action, damages, losses, costs, or liabilities arising out of or related to your use of the Services.
You agree to indemnify, defend, and hold harmless JIU JITSU FLO LLC and its owners from and against any third‑party claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.
4) No professional advice
The Services may provide information related to health, fitness, and wellness. This information is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. If you experience pain, dizziness, shortness of breath, or other concerning symptoms, stop immediately and seek medical attention.
5) Purchases; pricing; refunds
- Prices and offerings may change from time to time.
- For paid content, access is granted upon successful payment. Taxes may apply.
- Payments are processed by third‑party processors (Stripe). We do not store full card numbers.
- Refunds: Unless expressly stated on the checkout page, all sales are final. If a specific satisfaction guarantee or refund window is offered, its terms on the checkout page control.
- If we offer subscriptions in the future, your subscription will auto‑renew at the then‑current rate unless canceled before the renewal date. You can cancel from your account or by contacting us per Section 17.
6) License to use the Services
Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, non‑sublicensable license to access and view the course content for your personal, non‑commercial use. You may not copy, record, download, rebroadcast, distribute, sell, or create derivative works from the content except as expressly permitted.
7) Intellectual property
All content, trademarks, logos, graphics, videos, text, and software are the property of JIU JITSU FLO LLC or its licensors and are protected by intellectual‑property laws. No rights are granted except as expressly set forth in these Terms.
8) User content & testimonials
If you submit content (e.g., comments, reviews, testimonials), you grant us a worldwide, royalty‑free, perpetual, irrevocable license to use, reproduce, modify, publish, translate, distribute, display, and perform such content in any media, subject to our Privacy Policy. You represent that you own or have rights to any content you submit.
9) Prohibited conduct
You agree not to:
- Access or use the Services for any unlawful purpose;
- Share your login or allow others to access paid content;
- Copy, scrape, record, or otherwise reproduce content without permission;
- Interfere with the operation or security of the Services;
- Use bots or automated means to access the Services;
- Infringe or violate the rights of others.
10) DMCA & IP complaints
If you believe content infringes your copyright, send a notice to [email protected] with:
- Your contact information;
- Identification of the copyrighted work and the allegedly infringing material;
- A statement of good‑faith belief and the accuracy of your claim; and
- Your physical or electronic signature.
We may remove content and terminate repeat infringers in appropriate circumstances.
11) Availability; modifications; termination
We may modify the Services, discontinue features, or suspend/terminate access at any time, with or without notice, for any reason. We may remove content that violates these Terms.
12) Third‑party services
We may use third‑party platforms (e.g., Kajabi for hosting; Stripe/PayPal for payments; email/SMS providers; analytics/ads partners). Your use of those services may be subject to their own terms and policies.
13) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR‑FREE.
14) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
15) Governing law; binding arbitration; class‑action waiver
- Governing law & venue: These Terms are governed by the laws of the State of California, without regard to conflict‑of‑laws rules. Subject to the arbitration provision below, exclusive venue shall be in **Monterey County, California.
- Arbitration: Any dispute arising out of or relating to these Terms or the Services shall be resolved by **binding arbitration** administered by the **AAA** under its Consumer Arbitration Rules. The seat of arbitration is **Monterey County, California**. You and we **waive the right to a jury trial**.
- **Class‑action waiver:** Disputes must be brought in an individual capacity and **not as a class or representative action.**
16) International users
Access to the Services may not be legal in some countries. You are responsible for compliance with local laws.

18) Changes to Terms
We may update these Terms from time to time. The “Effective date” above indicates the latest revision. Continued use after changes means you accept the updated Terms.
19) Miscellaneous

- **No waiver:** Our failure to enforce a provision is not a waiver.
- **Assignment:** You may not assign these Terms without our consent.
- **Force majeure:** We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, labor disputes, internet outages).
